  • Assault with a weapon: Assault with a deadly weapon, assault with a weapon used in a threatening manner and generally any other circumstance where a weapon was used in the commission of an assault is considered aggravated assault and will be charged as a third degree felony offense. If convicted, you could face a penalty of up to 5 years in prison and up to a $5,000 fine.
